Section 1 – what do we do with your data?
When you buy something from our store, as part of the buying and selling process, we collect personal information that you give us, such as your name, address and email address.
When you browse our store, we also automatically receive your computer's Internet Protocol (IP) address to provide us with information that helps us learn more about your browser and operating system.
Email Marketing (if applicable): With your permission, we may send you emails about our store, new products, and other updates.
Section 2 – Consent
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for delivery, or return a purchase, we imply that you consent to its collection and use only for that specific reason and purpose.
If we request your personal information for a secondary reason, such as marketing, we will ask you directly for your express consent or provide you with an opportunity to say no.
How can I withdraw my consent?

Section 4 – Payment system
Our store is hosted on Gem Imports Ltd servers using private and secure data storage.
Payment
If you choose a direct payment gateway to complete your purchase, Smania stores your credit card information. It is encrypted using the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase information is only stored for as long as necessary to complete your purchase. After that, the purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS, which are managed by the PCI Security Standards Council, a joint effort by brands like Visa, MasterCard, American Express, and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
Section 5 – Third Party Services
In general, the third-party service providers we use will collect, use and disclose your information only to the extent they need it to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies regarding the information we are required to provide to them for your purchase-related transactions.
For these service providers, we recommend that you read their privacy policies so that you can understand how these data providers will handle your personal information.
In particular, please note that certain service providers may be located in facilities that are located in a different jurisdiction than you or us. Therefore, if you choose to proceed with a transaction that involves the services of a third-party service provider, then your information may be subject to the laws of the jurisdiction in which that service provider or its facilities are located.
For example, if you are located in Canada and a transaction is processed by a payment gateway located in the United States, then your personal information used to complete that transaction may be subject to disclosure under United States law, including the Patriot Act.
Once you leave our store website or are redirected to a third-party website or application, you are no longer subject to this Privacy Policy or our website Terms of Service.

CartFox
The Controller uses CartFox to send electronic messages to individuals (SMS, instant messaging applications, emails). CartFox's privacy policy and information about the CartFox provider are available here. The Controller manages personal data together with the CartFox provider.
The personal data of individuals processed within CartFox includes:
- e-mail address;
- telephone number;
- information about the website or application through which the e-mail address and/or phone number was submitted;
- messaging information:
- type of message (SMS, instant messaging application (type of application), e-mail);
- date of sending;
- sending time;
- the content of the message sent (e.g. abandoned cart, discount notification, etc.);
- information about the undelivered message (date and time of receipt of the non-delivery notification);
- information about the action performed (e.g. purchase of an item in an abandoned cart, purchase of a discounted item, etc.).
Personal data (email, telephone number) is automatically transferred to the joint controller.
The legal basis for processing personal data when using the CartFox service is:
- Consent, which serves to process the personal data of those individuals who have given consent to receive electronic communications.
- Legitimate interest, on the basis of which the controller processes personal data within the CartFox service only under the conditions set out below:
- the individual added at least one item to the shopping cart within the online store;
- the individual has provided their contact information (email and/or phone number);
- The message contains text that relates to an individual's (potential) purchase.
The purpose of processing personal data is to inform the individual about their (intended) purchase, as the messages sent by the CartFox service contain the following information:
- order confirmations;
- delivery news;
- post-purchase confirmations;
- abandoned cart reminders.
The primary purpose of these messages is transactional communication. The messages are intended to inform an individual about a business relationship with the Controller or Subscriber (e.g., purchase-related notifications).
The recipient may unsubscribe from receiving CartFox messages by using the unsubscribe options contained in the individual message sent to the individual by the CartFox service.
If you wish to unsubscribe from all communication channels sent by the data controller, you can contact the joint data controller at info@dfvu.org .
Personal data collected within CartFox is not disclosed to third parties (except for the joint controller, i.e. the CartFox service provider) and the controller does not have access to it. Within CartFox, the controller can only access reports that include aggregated and thus anonymous data (e.g. number of messages sent, number of purchases via messages sent, etc.).
Personal data processed within CartFox is not transferred to third countries or international organizations, which means that it is not transferred or exported outside the territory of the European Union member states.

Section 6 – Security
To protect your personal information, we take reasonable precautions and follow industry best practices to ensure that your information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, it is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. While no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
